Terms and Conditions

These Terms govern access to Highsky and purchases of advertising spots. Highsky is operated by Streamlined Solutions SRL, Vasile Alecsandri 72, Baia Mare, Romania ("Highsky", "we", "us", or "our").

By using Highsky, and specifically by accepting these Terms during Stripe Checkout, you agree to them. If you purchase for a company, you confirm that you have authority to bind that company.

1. The Highsky service

Highsky is a public, interactive advertising marketplace presented as an illustrated sky. A purchased campaign is displayed at a stable advertising spot using information such as the advertiser's company name, tagline, brand colour, public company imagery, and destination URL.

An advertising spot is a contractual display opportunity. It is not real property, a security, an investment product, or permanent ownership of any part of Highsky.

2. Eligibility

You must be at least 18 years old, have legal capacity to enter a binding agreement, and provide accurate campaign and payment information. Highsky is primarily intended for business advertising. Mandatory consumer rights continue to apply where they cannot legally be excluded.

3. Spot ownership and outbidding

Available spots may be purchased at the displayed price.
To replace a current owner, a new valid bid must be at least 1.5 times the current qualifying bid.
A spot changes ownership only after Stripe confirms payment and Highsky completes the transfer on the server.
Opening a spot, campaign form, or Checkout session does not reserve or transfer ownership.
The previous campaign stops occupying the spot after a successful outbid. The previous owner is not entitled to the new owner's payment or to a refund merely because the spot was later outbid.
Highsky may reject or reverse a transfer affected by fraud, payment reversal, technical error, sanctions restrictions, or a breach of these Terms.

4. Campaign requirements

You retain ownership of material you submit, but grant Highsky a worldwide, non-exclusive licence to host, reproduce, resize, format, and display it for operating and promoting the purchased campaign.

You confirm that you have all rights and permissions needed for the company name, trademarks, logos, domains, copy, and destination URL you provide. Campaigns must not contain or promote unlawful, deceptive, infringing, malicious, discriminatory, sexually exploitative, or otherwise harmful material. Destination URLs must use HTTPS and must not deliver malware, phishing, forced downloads, or deceptive redirects.

Highsky may review, reject, pause, or remove a campaign to protect users, comply with law, enforce these Terms, or preserve marketplace quality. Where practical, we will explain a moderation decision and allow correction. Refunds following removal are determined by the reason for removal, service already delivered, payment status, and applicable law.

5. Payments

Payments are one-time payments processed through Stripe-hosted Checkout. Prices and taxes shown at Checkout apply to that transaction. You authorise Stripe and Highsky to process the payment and related transaction information.

Payment does not guarantee activation if the campaign violates these Terms or fails required validation. If Highsky cannot activate a compliant campaign because of our own error, we will provide a correction, replacement, credit, or refund as appropriate. Chargebacks, reversals, or fraudulent payments may result in immediate suspension or removal.

6. Metrics and advertiser results

Highsky may provide aggregate click and impression estimates. Metrics can be affected by browsers, bots, network failures, fraud filtering, duplicate suppression, and technical limitations. We do not guarantee a minimum number of impressions, clicks, conversions, revenue, ranking duration, or business results.

7. Public links and third parties

Advertisers are responsible for their destination websites, products, claims, privacy notices, and legal compliance. Highsky does not endorse an advertiser merely because its campaign appears in the sky. Stripe, PostHog, Resend, hosting providers, and favicon or logo providers operate under their own terms and notices.

8. Availability and changes

We may maintain, improve, suspend, or change parts of Highsky, including world layout, controls, visual treatment, inventory, pricing rules for future purchases, and moderation standards. We will not intentionally alter the historical amount of a completed transaction. We do not promise uninterrupted or error-free availability.

9. Prohibited conduct

You must not interfere with the service, bypass rate limits or payment rules, manipulate metrics, automate abusive traffic, scrape Highsky in a way that harms the service, attempt unauthorised access, impersonate another business, or use Highsky to violate law or third-party rights.

10. Intellectual property

Highsky's software, world design, branding, interfaces, and original content belong to Streamlined Solutions SRL or its licensors. Except for the limited campaign-display licence described above, these Terms do not transfer intellectual-property rights between you and Highsky.

11. Disclaimers and liability

To the maximum extent permitted by law, Highsky is provided on an "as available" basis. We disclaim warranties that are not expressly stated or legally mandatory. Highsky is not liable for indirect, incidental, special, consequential, or punitive loss, lost profits, lost opportunities, advertiser content, or external websites.

To the maximum extent permitted by law, Highsky's aggregate liability arising from a purchased campaign will not exceed the amount you paid for the transaction giving rise to the claim. These limits do not apply where liability cannot legally be limited, including liability for fraud, wilful misconduct, or mandatory consumer rights.

12. Termination

You may stop using Highsky at any time. We may suspend access, reject campaigns, or remove advertising when reasonably necessary to enforce these Terms, address risk, or comply with law. Provisions that by their nature should survive termination remain effective, including payment, intellectual-property, disclaimer, liability, and dispute provisions.
